Licence Condition & Review
It is possible for prisoners to be released from prison ‘on licence’, meaning they are required to adhere to a set of conditions while serving the remainder of their sentence outside prison.
If any licence condition is breached – for example, a prisoner misses an appointment with their probation officer – the Probation Service can recommend that the prisoner is recalled to prison.
The decision to recall a prisoner is made by the Parole Board, which must act in accordance with guidance from the Home Secretary and also take account of any points the prisoner wishes to make.

Challenging a prison recall decision
It is very important for prisoners to challenge a recall decision in a licence review, as it can result in more months or years in prison.
To assist with this process, Noble Solicitors can:
- Obtain a full recall dossier to learn about the case in detail.
- Check the reasons for the recall, such as any problem with a licence condition.
- Make representations on the prisoner’s behalf to try to secure a re-release.
If the Parole Board accepts the representations made on behalf of the prisoner, it will immediately order a re-release.
